Former ENRC director set to fight lawsuit
FORMER ENRC director Sir Paul Judge has pledged to fight a lawsuit brought by the mining company over claims he leaked information to the media.
Judge said in a statement over the weekend that he “den[ies] entirely” the company’s claims that he leaked an email to the press in October.
Judge, who stepped down from his non-executive role in June, said he cannot return company documents to ENRC as requested, because the Serious Fraud Office has compelled him to hand over the papers as part of a probe into the firm.
“If ENRC persists in the legal action then I look forward to the day when the High Court examines the full factual background to ENRC, its directors, shareholders and this misconceived claim,” he said.
ENRC said on Friday that it had started a lawsuit against Judge, seeking damages and an injunction for breach of fiduciary duty.
The company is under investigation by the SFO for alleged corruption and fraud in Kazakhstan and Africa. It is also fielding a takeover offer by its biggest investors.
